Terms and Conditions of Service

For Tong A Travel Application Users

Section 1 Definitions

Under these terms and conditions, the following terms have the following meanings:

  • "Company" means Tong A Travel Co., Ltd. or any other name the company uses in operating the platform business
  • "Platform" means any application, website, or digital system developed by the company to serve as an intermediary connecting users with external service providers
  • "User" means any natural or juristic person who registers to use the platform to search, book, or use tourism services through the company's system
  • "Service Provider" means tourist attractions, guides, riders, drivers, operators, or any external parties who display their services on the platform
  • "Booking" means the user's agreement to select and use a service provider's service through the platform, whether or not advance payment is made
  • "Service Agreement" means the contract that arises directly between the user and the external service provider after booking through the platform

Section 2 User Registration and Identity Verification

  • Users must register a user account through the platform by providing accurate, current, and verifiable information such as name, phone number, email, or other information as specified by the system
  • Users warrant that the information provided to the company is truthful. If any information is false or causes damage to the company or others, the company has the right to suspend or cancel the user account immediately without prior notice
  • Users must keep account information, passwords, and platform access methods confidential. Any actions taken through the user's account are deemed to be actions of that user
  • Users must be at least 18 years old or have legal guardian consent. If violated, the company is not responsible for any damages that occur

Section 3 Platform Service Scope

  • The company acts as an "intermediary platform service provider" to facilitate searching, comparing, and booking tourism services from external service providers
  • The company is not a direct tourism service provider and is not a party to the service agreement between users and service providers
  • When users make bookings through the platform, the service agreement arises directly between User ↔ External Service Provider. The company's status is merely "system and channel supporter"
  • The company does not guarantee the quality, safety, accuracy, or continuity of services provided by external service providers, except where the law requires the platform to be responsible
  • However, the company will take appropriate action in selecting, displaying information, and providing complaint channels to protect users' interests reasonably

Section 4 Booking and Payment

  • Users can make service bookings through the platform according to the system's specified procedures. Booking information will be automatically sent to the service provider
  • Bookings are complete when users confirm the service provider's conditions and make payment (if any) as specified by the system
  • The company may act as payment recipient on behalf of service providers for user convenience. Such payment receipt does not make the company a direct tourism service provider
  • Users acknowledge that prices, conditions, times, and service details are information determined by service providers. The company only displays information as received

Section 5 Cancellation, Refund, and Booking Changes

  • Cancellation and refund conditions are as determined and displayed by service providers on the platform
  • Users must check such conditions before making bookings. If users cancel afterward, the company has no responsibility for damages arising from service provider conditions
  • The company may help mediate between users and service providers in case of disputes regarding cancellation or refund, but has no responsibility on behalf of service providers
  • If a service provider cancels or fails to deliver the booked service, users are entitled to a full refund, which will be processed within 7 business days from the confirmed cancellation date
  • For refunds approved by service providers, the company will process the refund within 7–14 business days. Refunds will be returned via the original payment method used at the time of booking

Section 6 User Rights and Obligations

Users agree and warrant that:

  • They will use the platform in good faith, not for fraud, deception, or violation of laws
  • They will not take any action that affects the system, security, or reputation of the company
  • They will comply with rules, regulations, and conditions of each service provider
  • They will be responsible for any damages arising from use of their own account

Section 7 Liability and Limitation of Liability

  • The company is not responsible for actions, negligence, or quality of services provided by external service providers
  • The company does not guarantee that service providers will fully comply with agreements with users
  • In case of disputes between users and service providers, it is considered a dispute between the two contracting parties directly. The company has no status as a contracting party
  • The company's liability (if any) is limited only to damages arising from platform system defects and not exceeding the value of fees received by the company from that booking

Section 8 Security and Account Usage

  • Users must maintain confidentiality of account and password
  • If there is unauthorized use, users must notify the company immediately
  • The company has the right to temporarily suspend accounts for system security

Section 9 Personal Data Protection

  • The company will collect, use, and disclose users' personal data according to personal data protection laws
  • Users consent to the company sending necessary information to service providers to proceed with bookings
  • The company will use appropriate measures to maintain data security

Section 10 Account Suspension or Cancellation

  • The company has the right to suspend or cancel user accounts if it is found that users:
    • Provide false information
    • Use for improper purposes
    • Violate terms or laws
  • Account cancellation does not affect rights and obligations that arose previously

Section 11 Complaints and Dispute Resolution

  • Users can file complaints through channels specified by the company
  • The company will try to coordinate to resolve problems appropriately
  • If agreement cannot be reached, parties should use mediation before litigation

Section 12 Governing Law

These terms and conditions are governed by Thai law. Any disputes shall be subject to the jurisdiction of Thai courts
